There have been many improvements in workplace safety over the years.  However, many people are seriously injured or killed each year in Ontario due to workplace accidents.

Your entitlement to compensation for a workplace injury depends on whether the Workplace Safety and Insurance Act, 1997 (“WSIA”) applies to your case.

You can start a lawsuit

If the WSIA does not apply, you can start a lawsuit against  anyone you feel was wholly or partly at fault for your accident.  For example, you may be able to prove that your employer did not provide you with sufficient training or appropriate equipment.  You may be able to prove that the equipment you were using was defective or that the manufacturer did not provide proper instructions about how to use the equipment safely.

You will have to prove you are entitled

If the WSIA applies to your case, you will not have to prove that someone else was at fault for your accident.  In this respect, WSIA benefits are similar to “no fault” benefits for car accidents.  You will have to prove you are entitled to the various benefits available under the WSIA.
