2. Contingency Fees
“Contingency fee” agreements typically provide that a lawyer will not charge you any fees unless you recover damages from the defendant, and that no fees will be payable until you recover damages. In other words, you owe your lawyer nothing unless and until you receive compensation from the defendant. The amount of the lawyer’s fee is a percentage of the amount you recover.
Although you can ask to be billed on an ongoing basis based on the lawyer’s hourly rate, almost all injured clients prefer a contingency fee. Injured clients generally are in financial distress and they have difficulty paying lawyers’ bills on an ongoing basis.
