Ontario Car Crash Injuries Tort No Fault Claims Toronto Accidents
Injured in a Car Accident?
Car accidents are the most common cause of serious personal injury in Ontario. The legislation governing motor vehicle claims is complex and the Ontario government has changed the legislation several times in the last 15 to 20 years. However, if you are injured in a car accident, you have two basic ways to seek recovery: by claiming “statutory accident benefits” and by suing the person or persons at fault for the car accident.
No-fault benefits
“Statutory accident benefits” are also sometimes called “no-fault” benefits. As the name suggests, you can claim these benefits even if you are completely at fault for a car accident.
The Tort Claim
The lawsuit against the person or persons who caused the car accident is sometimes called a “tort” claim. To succeed with this claim, you must be able to prove that the other person was at least partly responsible for the accident.
Accident benefits claims and tort claims are subject to a great deal of complex legislation
